Peterborough City Council (PCC), is looking to award an "Pseudo Dynamic Purchasing System" which PCC, Cambridgeshire County Council (CCC) and Cambridgeshire and Peterborough Clinical Commissioning Group (CCG) will be entitled to call off from. The Procurement is being run using a procedure similar to the open procedure described in Regulation 27 of the Public Contracts Regulations 2015 (as amended). However, the Authority reserves the right to deviate from the formalities of the open procedure given the flexibilities permitted by Regulation 76 of the Public Contracts Regulations 2015 (as amended) in the conduct of procurements for "Social and Other Specific Services”, otherwise referred to as “Light Touch Regime” procurement.

The Authority intends to re-open the multi supplier “pseudo DPS” (referred to as “DPS”). As the DPS Agreement will be “pseudo DPS”, it will look and feel similar to a DPS agreement set up under Regulation 34 of the PCR. This means that the Authority envisages the DPS will re-open (6) six months after the DPS start date (May 2021) and then at (12) twelve month intervals (or at other intervals at the Authority’s discretion) for new providers to apply or previously unsuccessful providers to re-apply subject to the terms and conditions of the Framework and evaluation process.

Tenders are therefore invited from suitably experienced providers who can demonstrate knowledge and experience in the provision of Early Intervention and Prevention across Cambridgeshire and Peterborough.

The requirements will be split into Lots as detailed below

Lot 4 Day Opportunities (This Lot is unlikely to be activated immediately)

At the time of issuing this ITT, it is not believed that TUPE Regulations 2006 will apply due the nature of the DPS Contract. It is therefore deemed that no TUPE implications will apply at this time. The Authority envisages that TUPE may apply at the time where the Authority and/or the Partner Organisations issue the Mini Competition Invitation to Tender. Where it applies, relevant TUPE information will be provided in the Mini Competition Invitation to Tender including a TUPE list of existing employees and their terms and conditions of employment and whether or not any of them are existing members of the Local Government Pension Scheme, the NHS Pension Scheme or a private provider of the Authority and Partner Organisations. Bidders should note that further information may be forwarded from existing providers in relation to TUPE which will need to be considered within their Bids. However, Bidders are advised that they should seek independent legal advice on the matter of TUPE and the Authority and Partner Organisations accept no liability for any TUPE-related information or comment set out in this ITT or any subsequent Mini Competition Invitation to Tender.

Should it apply then bidders will be required to download, sign and upload through the Messages section, a TUPE Undertaking of Confidentiality in the Authorities e-procurement system, ProContract, before TUPE details and information can be released.
