three.1.3) Technical and professional ability

List and brief description of selection criteria

Bidders will be required to provide examples of works carried out in the past five years that demonstrate that they have the relevant experience to deliver the work as described in part II.2.4 of the Find a Tender Service Contract Notice or the relevant section of the Site Notice.

If bidders intend to use a supply chain to deliver the requirements detailed in the Contract Notice, they will be required to confirm that they have (or have access to) the relevant supply chain management and tracking systems to ensure a resilient and sustainable supply chain.

Bidders will be required to include confirmation that they have the systems in place to pay subcontractors through the supply chain promptly and effectively.

Bidders will be required to confirm that they and/or the service provider, and managerial staff have the relevant educational and professional qualifications.

Bidders will be required to confirm their average annual manpower for the last three years, and their number of managerial staff for the last three years.

Bidders will be required to demonstrate that they have (or have access to) the relevant tools, plant or technical equipment. Bidders will be required to confirm if their proposed equipment is owned or if they will hire/lease the equipment. There are minimum engine requirements and bidders must confirm if their proposed equipment will meet these requirements. The minimum engine requirements are: excavators and dumpers must be Stage IV engine class or higher; and road-going heavy goods vehicles, such as tippers, must be Euro V engine class or higher.

Bidders will be required to confirm whether they intend to subcontract and, if so, for what proportion of the contract.

Any bidder that receives a score of zero (0) or one (1) for one or more technical questions will be excluded from the tender.

Any bidder that receives an overall technical score of below 50% out of 100% (of the 60% overall quality weighting) will be excluded from the tender.

The Client may modify the contract, irrespective of the monetary value of modifications, within the scope permitted under Regulation 72(1), and specifically under Regulation 72(1)(a) of the Public Contracts (Scotland) Regulations 2015, should operational reasons require it.

Reasons for modification may include, but are not limited to:

- a change (increase or decrease) in the Client’s budget to deliver the service;

- a change in government policy;

- a change in public procurement policy;

- a change to the Client’s core road specification;

- a change to the Key Performance Indicators;

- a change to the reporting requirements;

- climate emergency initiatives or developments related to roads maintenance and associated services; or

- additional unforeseeable requirements related to roads maintenance and associated services.

In the event of a modification being required, the pricing shall be as per the applicable contract rates at the time of the modification.

The Police Service of Scotland has identified that this is a business area which may be attractive or vulnerable to exploitation by serious organised crime groups. Bidders will be required to complete a Declaration of Non-Involvement in Serious Organised Crime in order to submit a tender.
