Explanation:

The Turret Weapons Systems (TWS) team within the DE&S Vehicle Demonstration & Manufacture (VDM) Delivery Team, part of the UK Ministry of Defence (“MoD”), intends to award a Contract to Nottingham Small Arms Factory (NSAF) Limited to cover the procurement of quantity 265 off 7.62mm Chain Gun (CG) Complete Equipment Schedule (CES) kits, in order to operate and maintain CG currently being fitted to the AJAX platform.

It is considered that this Contract can be placed using the Negotiated Procedure Without Prior Publication of a Contract Notice pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011) for technical reasons.

This is because NSAF Limited has the necessary access to the OEM Design and Technical documentation relating to the 7.62mm Chain Gun and ancillary equipment. The proprietary technical knowledge, technical drawings and data packs are required to fulfil this requirement. Without access to this information no other contractor would be able to fulfil this requirement to the technical and safety standards required.
