Section four. Procedure

four.1) Description

four.1.1) Type of procedure

Award of a contract without prior publication of a call for competition in the cases listed below

Explanation:

The International Guns, Missiles and Rockets (IGMR) Project Team, part of the United Kingdom Ministry of Defence (UK MOD), intends to award a contract (708100450) to Saab Dynamics AB (the Company) for Contractor Logistic Support (CLS) and Post Design Services (PDS) for the Next-generation Light Anti-tank Weapon (NLAW) System and the Carl-Gustaf Weapon System (the Equipment). Tasks to be carried out by the Company under the contract will include but are not limited to:

a. Technical advice.

b. Defect investigation and repairs.

c. Maintenance, modifications, and obsolescence management.

d. Spares.

e. Trials, analysis and testing.

f. Specifications and drawings.

g. Safety certification.

The duration of the contract will be 5 (2+3) years and the estimated total value is £4.75M.

It is considered that this contract can be placed using the negotiated procedure without prior publication of a contract notice pursuant to Regulation 16(1)(a)(ii) of the Defence and Security Public Contract Regulation (DSPCR) 2011 for technical reasons.

The Company is the Design Authority (DA) and Original Equipment Manufacturer (OEM) of the Equipment and, as such, is the only organisation with the requisite technical knowledge, expertise, and know-how necessary to fulfil the requirement as it holds the proprietary information, including all the available technical information (drawings, interfaces, test and calibration specifications/ procedures, jigs, and tools etc.) necessary to undertake the full in-service support of the system and to ensure that it operates safely.

The Company also owns and maintains the master design documentation underpinning the safety case and is able to underwrite any safety modification should they be required. It is considered that awarding a contract to any other organisation would present an unacceptable safety risk.

It is for the reasons listed above that the Company is the only operator able to perform the contract.
