four.1) Description

four.1.1) Type of procedure

Award of a contract without prior publication of a call for competition in the cases listed below

Explanation:

Article 28(1)(e) of Directive 2009/81/EC Regulation 16(1)(a)(ii) of the Defence and Security Public Contract Regulations 2011 for technical reasons. Meggitt are the Design Organisation (DO) for systems used within the High-Altitude Parachute Life Support System (HAPLSS) Capability which includes the Aircraft Modular Oxygen Systems (AMOS) enabling parachutists to pre-breathe oxygen when flying at High Altitudes and Personal Oxygen Regulators used in both flight and when parachuting from High Altitudes. These were originally manufactured by (or companies that are now part of) Meggitt UK Limited.

In addition to their DO role, they are the only known company with the capability to provide repair, overhaul, spares provision and conduct the necessary climatic & altitude acceptance tests for these critical life support Oxygen Regulators. The HAPLSS is due to be replaced by a new capability within 4 years and therefore it would not be economical for another company to invest in setting up a test and repair facility and have access to spares.
