Deprivation of Liberty Safeguarding (DoLS) is a statutory function for the Local Authority and supports the most vulnerable people. DoLS applies to people from 18 years old and outlines the process by which a person can be deprived of their liberty. It applies to individuals who lack capacity (as defined by the Mental Capacity Act 2005 and following formal assessment) to make decisions relating to their residence, wellbeing and care and treatment.

seven.2) Information about modifications

seven.2.1) Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

1 year extension to 10th June 2024.

An increase to assessments to approximately 60 per month (from 50 per month)

An increase to the assessment rate and inclusion of mileage payments for out of city (Coventry, Warwickshire, Birmingham and Worcestershire) assessments

seven.2.2) Reasons for modification

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee.

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

The Council could not have foreseen the changes / timescale impacts as a consequence of legislation - at time of extension/modification approval, DOLS was known to be replaced by Liberty Protection Safeguards (LPS), following the Mental Capacity (Amendment) Act 2019. The Government was considering the responses following the consultation for the draft Code of Practice for the Mental Capacity Act & LPS and the text of the Code will go back to Parliament for ratification.

The impact of legislative changes is not yet known and the requirement can not therefore be re-tendered.
