Explanation:

The Education Authority requires the provision of transport services across existing Public Transport Network in Northern Ireland i.e collection of pupils from any/all Northern Ireland bus stops and train stations and drop offs at destination bus stops and train stations. Translink Group are regulated by the Transport Act (Northern Ireland) 2011 as the only service provider to provide a service of the scope and scale required. This service requirement therefore falls under Regulation 32 (2)(b). The proposed contract is permitted by Regulation 32 (2)(b) of PCR 2015. As explained herein are necessary:

Competition is absent for technical reasons and the protection of exclusive rights and no reasonable alternative is available. Public transport in Northern Ireland is regulated under Transport Act (Northern Ireland) 2011 under power conferred by section 1(2) to enter into service agreements including the power to award service contracts in accordance with Regulation (EU) No 1370/2007. The Education Authority tender for all other transport services including bus and taxi services using a Dynamic Purchasing System.
