In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (in accordance with the relevant legislation) is lawful in accordance with Regulation 16(1)(a)(iv) of the DSPCR 2011 for reasons of extreme urgency brought about by events unforeseeable by, and not attributable to, the contracting authority (the Ministry of Defence), the time limits specified in regulation 17 for the restricted procedure, or regulation 18 for the negotiated procedure, cannot be met.
This is because an immediate risk and credible Risk to Life and material exists for ongoing operations as a result of Un-crewed Aerial System (UAS) threat. The fastest and most effective solution to reduce Risk to Life is to rapidly procure a credible, 24 hour capable Counter-UAS capability. The SAAB G1X radars are a proven capability and as such there is a high degree of confidence among C-UAS experts that this will meet the requirement.
