The contracting authority is not awarding new contracts. This VEAT notice is in respect of a proposed modification to extend Greater Manchester Combined Authority’s existing contracts for waste and resource management services and for household waste recycling centre management services along with some additional works to upgrade an existing energy from waste facility and associated services, provision of cashflow relief in respect of electricity income during the additional works, an acceleration of existing planned lifecycle works, a change to the payment mechanism for rail subcontract services, upgrades to an existing facility to enable the early acceptance of plastic pots, tubs and trays, commitments as to terms on which biowaste disposal sub-contracts are let. This is not a new contract opportunity, but rather a VEAT notice to inform the market that the contracting authority is seeking to extend its existing contract for waste and resource management services with Suez Recycling and Recovery UK Ltd which was originally awarded in 2019 and is due to expire on 31 May 2026.
The extension period will be for an initial three year period until 31 May 2029 and then for a further five year period until 31 May 2034, exercising the existing options to extend under clauses 3.4.1 and 3.4.2 (respectively) of the waste and resource management services contract.
In addition, it is proposed that additional works are undertaken to upgrade an existing energy from waste facility at Raikes Lane, Bolton. It is intended that the contracting authority will provide short term cashflow relief in respect of electricity revenue not realised during these additional works in consideration for a subsequent increase in share of electricity revenue until such relief has been earned back. It is further proposed that certain existing planned lifeycle works at the Raikes Lane facility are accelerated.
Payment for rail haulage under a subcontract shall be varied from a fixed cost basis to a pass through cost basis.
Further upgrades to an existing facility are planned to enable the early acceptance of plastic pots, tubs and trays.
There is also a commitment from the contractor as to the terms on which contracts for the disposal of biowaste until the end of the proposed extension periods are established.

four.1) Description

Explanation:
This VEAT notice relates to modifications to the WRMS and HWRCMS contracts originally awarded in 2019 following a competitive award process. The contracting authority considers that the modification is permitted by Regulation 72(1)(e) of the Public Contracts Regulations 2015 as a modification which is not substantial. The proposed extensions of both contracts are pursuant to clear, precise and unequivocal review clauses (clause 3.4.1 and 3.4.2) of the original contracts. The contracting authority considers that the other proposed modifications to the WRMS contract as set out in section II.2.4 above are not substantial as they do not render the contract materially different in character or considerably extend its scope. The contracting authority also considers that there is no change in the economic balance of the contract in favour of the contractor as a net result of the proposed modifications. In addition, the contracting authority does not consider that if the WRMS contract had originally been advertised to include the proposed modifications that it would have attracted any different participants or candidates or that the outcome of the original procurement would have been any different.
