seven.2) Information about modifications
seven.2.1) Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):
DfE are seeking a modification of £300k and to extend the contract period for an additional 14 months. The drilling element of the project on the Stormont Estate is now considered development and as such requires planning approval. As a result of the need to apply for planning permission the contract cannot be completed within the original timescale. The extended timescale has resulted in more contract management costs for the contractor - Tetra Tech and their communications company.
seven.2.2) Reasons for modification
Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee.
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:
This is on the basis that the planning approval required for drilling was unforeseen by the Client at the time of tender and the Client only received advice following the award of the contract that the project should be treated as a major project for planning purposes which will cause a time delay and associated increased costs that could not have been foreseen. The contract end date of January 2024 is now unrealistic as the Client will only likely receive drilling approval in January 2024 which has caused a need to extend the contract to March 2025 to ensure enough time for the drilling to be undertaken. The contract changes proposed by the Client do not affect the overall nature of the contract and the proposed £300,000 contract variation does not exceed 50% of the value of the original contract value.
This increase of time and value will be subject to the same Terms and Conditions as per the original contract.
