The Council has taken on responsibility to provide Accommodation for the Ukrainian re-settlement scheme previously delivered by the Scottish Government. The procurement is for suitably sized temporary accommodation on short-term lets for adults and families.

two.2.4) Description of the procurement

The City of Edinburgh Council has taken on contractual responsibility for some of the Scottish Government's Welcome Accommodation, previously provided by Scottish Government via their contracted partner Corporate Travel Management.

Since 2021 there has been a range of welcome accommodation across Scotland, including hotels, apartments, aparthotels and, previously, cabins onboard M/S Victoria and M/S Ambition. Should a displaced person from Ukraine require welcome accommodation, it is, in the majority of cases, allocated via the core welcome hub in Edinburgh. When in welcome accommodation, matching discussions will take place to secure an offer of suitable longer-term accommodation.

This contract is for a small number of temporary self-contained apartments for those still awaiting an offer of suitable longer-term accommodation.

It should be noted that all contract values stated within this notice are maximum indications only over the full term of the call-off, funding for which has been provided by the Scottish Government.

four.1) Description

Award of a contract without prior publication of a call for competition in the cases listed below

  • Extreme urgency brought about by events unforeseeable for the contracting authority

Explanation:

Direct Award using the Light Touch Regime provisions of the Public Contract (Scotland) Regulations 2015.

The Council entered into negotiations with the provider under the Procurement Reform (Scotland) Act 2014, which states that Public Sector Organisations may award without seeking offers, considering the principles of procurement where relevant.

In this instance, there was a lack of suitable supply market the Council could access within the time required. This award is a temporary measure only.

The Council has re-opened and extend provision under its Temporary Accommodation Flexible Procurement System Framework (CT0627) for future requirements.

six.3) Additional information

This is a short-term award to meet un-foreseen need while the Council re-opens its Temporary Accommodation Flexible Purchasing System.

Please note, the Contract value is a potential maximum spend over a full three year period, and not a likely indication or actual contractual spend on this provision, funding for which has been provided by the Scottish Government.

It is a mandatory requirement of this Contract that a prompt payment clause is present in all Contracts used in the delivery of the requirements. This ensures payment of sub-contractors at all stages of the supply chain within 30 days and includes an obligation to provide a point of contact for sub-contractors to refer to in the case of payment difficulties. This will require active monitoring of payment performance as well as the provision of evidence and reports to the Council on request or as contractually scheduled.

It is a mandatory requirement that organisations pay staff who work on the council framework pay at least the real Living Wage.

An economic operator that suffers or risks suffering loss or damage attributable to a breach of duty under Public Contracts (Scotland) Regulations 2015 may bring proceedings in the Sheriff Court or Court of Session. A claim for an ineffectiveness order must be made within 30 days of the Contract Award Notice being published in the Find a Tender Service or within 30 days of the date those who expressed an interest in or otherwise bid for the contract were informed of the conclusion of the contract or in any other case within 6 months from the date on which the contract was entered into.
