four.1) Description

Explanation:
Under the Regulations, a Utility can award a contract following a negotiated procedure without prior publication of a call for competition whereby:
“competition is absent for technical reasons” (clause 48;1;c;ii)
The cable systems have been designed, developed, prequalified, type tested, manufactured and installed by NKT – the OEM. The proprietary and intellectually protected nature of the supplied works presents significant design-life uncertainty, in the event a vendor, other than the OEM, would provide the LTSA services. Each component of CMS HVDC cable systems has been prequalified and type tested (in accordance with Cigré TB 496) as part of a complete system. Prequalification and type test verification to this international standard is a fundamental quality assurance for this multi-terminal HVDC transmission system; a key component within the UK’s Main Interconnected Transmission System (MITS).
Introducing cables or accessories from another vendor, which have not been tested as part of the same complete system, to the same standard, would introduce an unacceptable level of technical risk to the Employer’s asset.
