Section four. Procedure
four.1) Description
four.1.1) Form of procedure
Award of a contract without prior publication of a call for competition in the cases listed below
- No tenders or no suitable tenders/requests to participate in response to open procedure
Explanation:
An open procedure was conducted which resulted in only one bidder submitting a tender for all the Lots. The submitted was not suitable for acceptance. Rather than amending the conduct of the procurement as provided for in in Regulation 76.4, the Council chose to follow the procedure in Regulation 32(2)(a). As there were no suitable tenders the Council entered into negotiation with the sole bidder to achieve a suitable tender that was acceptable with no substantial alterations to the initial conditions of the contract and therefore an award is justified under Reg 32(2)(a).
