four.1) Description

four.1.1) Type of procedure

Award of a contract without prior publication of a call for competition in the cases listed below

Explanation:

The Complex Weapons Future Portfolio Team within Defence Equipment & Support (DE&S), which is a part of the UK Ministry of Defence (the Authority), intends to place an 18 month Assessment Phase contract with MBDA UK Ltd to assess and de-risk the development and implementation of new acquisition approaches and methodologies in the development, qualification, manufacture and support of Complex Weapons.

It is considered that this contract is exempt from the application of the DSPCR in accordance with Article 346(1)(b) of the TFEU (as it was launched prior to 31 December 2020), for reasons connected with the protection of essential security interests, namely the continuation of the UK’s Operational Advantage and Freedom of Action.

These national security interests necessitate the Authority maintaining a sustainable sovereign industrial base for the supply of Complex Weapons. Only MBDA UK Ltd, as the Authority’s predominant supplier of heavyweight Complex Weapons, has the necessary in-depth technical knowledge, specific know-how, designs, and production facilities at its disposal to provide the required portfolio of products and services.
