four.1) Description

four.1.1) Type of procedure

Award of a contract without prior publication of a call for competition in the cases listed below

Explanation:

The Defence Equipment & Support, part of the UK Ministry of Defence (the “Authority”), intends to award a contract to Speedgoat GmbH for the provision of real-time simulation and testing hardware for a period of three years. In accordance with regulation 4 of the Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (as required by the relevant legislation) is lawful in accordance with Regulation 16(1)(a)(ii) of the DSPCR 2011 for technical reasons. These technical reasons are as follows: Typhoon DT are procuring equipment to the specification of an existing real time simulation and testing system designed by the DSTL. DSTL’s system is a cross platform system that has been designed and developed before Typhoon DTs involvement. DSTL’s real time simulation and testing system runs models have been designed to operate exclusively using Speedgoat hardware for technical reasons. Not using Speedgoat hardware would require a redesign of the system. This redesign would require several years of contracted-out work, would incur significant avoidable cost, and would result in a system with less reliability than the current design. In order to optimise full value from the DSTL system to the Typhoon Lighthouse programme, the Typhoon DT have been directed to match DSTL’s System setup covering hardware, software and system support. Any variations to the hardware, software or system support procured by Typhoon DT versus the extant system specification would prevent Typhoon DT’s participation with the DSTL programme.
