Section four. Procedure
four.1) Description
four.1.1) Type of procedure
Award of a contract without prior publication of a call for competition in the cases listed below

Explanation:
The college currently have 5 full mission simulators supplied and maintained by Wartsila. By continuing this relationship, it will allow us to expand our offering whilst maintaining full technical integration and compatibility with our existing bridges 2-5.
We also have 3-part task labs with 36 deck stations, and a 24-station part task engine simulator which are also Wartsila, so allows for a familiar student experience.
Hardware from bridge 1 will be reused in one of the new bridges.
New and existing engine and bridge simulators to be linked for joint exercises.
Should the college have opened this requirement up to competition, all existing hardware and software licences would be obsolete. This would result in not only the bridge simulators being replaced, but the instructor stations, 32-part task simulators being replaced, 24 desktop engine simulators being replaced and a full mission engine room simulator being replaced at considerable costs.
Should we go to full tender, all existing simulators would need to be replaced to allow for joint operations to take place.
The current maintenance agreement we have in place with Wartsila for the existing simulators would not be fit for purpose should we change suppliers. This contract has an outstanding commitment of 370k GBP.
With reference to IP rights, the exercises that have been created for students, at extensive time and cost to the College, are only compatible with the Wartsila software. Likewise, we have had a number of bespoke vessels/areas created by Wartsila for clients. If the College were to change manufacturer, whilst these would remain the property of CoGC, they would be rendered obsolete and the work would need recreated internally or by new manufacturer at additional cost.
