Accommodation Based Respite Support for Adults (and children 16+ in transition to adulthood) with a learning disability and/or autism who may display behaviour that challenges, including those with a mental health condition and/or a physical disability. Cheshire East Council are seeking 2 residential beds to serve the North of the Borough and 2 residential beds to serve Crewe/Nantwich (South of the Borough). Note - the participation and process for this tender will be via the electronic tendering portal located at www.the-chest.org.uk. Please ensure you also refer to section VI.3 of this notice.

Cheshire East Borough Council will incorporate a standstill period at the point information on the award of the contract is communicated to tenderers. That notification will provide full information on the award decision. The standstill period, which will be for a minimum of 10 calendar days, provides time for unsuccessful tenderers to scrutinise the award decision before the contract is entered into. The Public Contracts Regulations 2015 (SI No102) provides for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland).

seven.2) Information about modifications

seven.2.1) Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

An extension was previously exercised to extend this contract for two years from 01/12/2021 to 30/11/2023 (as per the original terms and conditions of the contract). A previous modification to add an additional flat (5 now, rather than 4 flats) has also been done.

This modification includes an extension to the contract, from 01/12/2023 until 01/03/2025, as well as an overall contract price increase in order to cover costs.

Need for additional works, services or supplies by the original contractor/concessionaire.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Respite Provision

An alternative option would be to spot purchase flats as and when required. This is not considered to be the best course of action as there is the demand to justify the purchase of an additional flat. Plus, it would not be guaranteed that a flat would be available on a spot contract basis, potentially limiting availability.

From a value for money perspective, extending and uplifting the respite service would be the best course of action for the Council. It is significantly less in terms of the proposed weekly costs compared to other adults and children's respite provisions, and helps to ensure that this provision is located within Cheshire East, not away from the individual's family and networks.

Use In-house Provision

Cheshire East Council also has another in house learning disability respite service, however, this service is currently under review as part of the Medium-Term Financial Strategy 2023/24. A need has been identified which includes ensuring that this respite service continues to be delivered to enable Cheshire East Council to continue to meet its statutory requirements under the Care Act (2014) to provide carer respite.

Further Justifications

By putting in place the extension until 1 March 2025, this would allow commissioners to monitor emerging demand and gain a greater understanding of future options and service models for respite for the identified cohorts. A full recommission of respite will then be undertaken.
