The jointly tendered Agreements will represent ALL sexual health services commissioned by Staffordshire County Council, Stoke on Trent City Council, and Telford and Wrekin Council, and HIV Services in the three local authority areas commissioned by NHS England and NHS Improvement including:

a. All levels of genitourinary medicine (GUM) - including testing and treatment of sexually transmitted infections (online and face to face services)

b. Long Acting Reversible Contraception (LARCs)

c. Contraception and sexual health (CaSH) services

d. The sexual health aspect of psychosexual counselling

e. Prevention of issues related to sexual health

f. Specialised-human-immunodeficiency-virus-HIV-services-adult (for NHS England)

g. Provision of Community Pharmacy Services

For Lot one, Sexual Health Services and HIV Services for Staffordshire, Stoke on Trent and Telford & Wrekin there will be 4 setparate Service Agreements that will apply to this Procurement. Each Local Authority will have their own Service Agreement with the successful Supplier. The documents are entitled as follows:

The combined estimated total agreement value for the period for lot one is £66,971,659 - £70,000,000. A range has been as allowed for should there be additional funding awarded to the Authorities during the Agreement Period.

Lot Two is for the provision of Sexual Health Services In Community Pharmacies In Staffordshire, Telford & Wrekin.

The Services to be delivered are:

Oral Emergency Hormonal Contraception (EHC)

Chlamydia and Gonorrhoea Screening and Treatment of Chlamydia

Pregnancy Testing

This Agreement is based on activity delivered. The Annual Agreement value is the maximum that is available to the Supplier. Therefore, the estimated Total Agreement Value for Lot two is £1,323,000.

The Contracting Authority will incorporate a minimum 10 calendar day standstill period (or 15 days where non electronic or fax methods are used) at the point that an award decision notice is communicated to tenderers.

The award decision process will specify the criteria for the award of the contract/framework agreement, the reasons for the decision, including the characteristics and relative advantages, the name and score of the successful tender(s), and will specify when the standstill period is expected to end or the date before which

the Contracting Authority will not conclude the contract. If an appeal regarding the award of a contract has not been successfully resolved, the Public Contracts Regulations 2015 provide for aggrieved parties who have been harmed or are at risk of a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 3 months). The Court may order the setting

aside of the award decision or may order the Contracting Authority to amend any document and may award damages. If an agreement has been entered into the Court may make a declaration of ineffectiveness or may order that the duration of any relevant specific contract be shortened and additionally may award damages.

The time limit for seeking such a declaration is generally 30 days from notification of the award (either by award decision notification or contract award notice depending upon the circumstances) or otherwise 6 months
