The purpose of this Prior Information Notice (PIN) is: (a) to give potential tenderers advance notice that the (FCA) are currently evaluating its options prior to undertaking a tendering exercise for an eDiscovery solution, and (b) to advise potential suppliers of an upcoming Supplier Engagement which will be held during July/August 2024.
The Enforcement and Markets Oversight division within the FCA has approximately 400 employees, not including contractors, that use the eDiscovery software, which currently stores around 160 million documents. Digital evidence review and analysis are core capabilities required to support regulatory, civil and criminal case work. The quality of these capabilities has a direct impact on the FCA’s ability to undertake effective and efficient enforcement action and to assist the FCA with effective credible deterrence.

The requirement is for an eDiscovery SaaS Solution with the ability to deliver the following outcomes:
• Ability to ingest large volumes of data
• Ability to perform E effective evidence management and create production of reviewed material
• Ability to conduct appropriate management of sensitive/protected information
• Ability to apply the use of advanced technology features where applicable
The system must be able to provide the below key strategic functionalities:
• Industry standard productions
• A robust and scalable intuitive system
• We are looking for a supplier that can deliver a partnership approach.
Additionally, as part of this engagement the FCA would like to understand if eDiscovery suppliers are able to deliver an evidence Property Management Store (ePMS) solution. The requirement is for an ePMS Solution with the ability to deliver the following outcomes:
• Ability to capture and store physical evidential details electronically
• Ability to remotely capture and store physical evidential details electronically
• Ability to manage access to the exhibits
• Ability capture data remotely
Following the pre-market engagement, the FCA will consider if eDiscovery and ePMS will be tendered as one or two separate solutions.
