two.1.4) Short description

Wolverhampton City Council (the “Council”) invites bids for admittance to the framework from suitably experienced and qualified Provider’s to undertake ad hoc Deprivation of Liberty Safeguards (DoLS) assessments. This will be on an independent basis on behalf of the Supervisory Body (the “Council”).

The assessments are carried out under the provisions of the Deprivation of Liberty Safeguards legislation 2009 which forms part of the Mental Capacity Act 2005. This contract is only valid while the Deprivation of Liberty Safeguards 2009 is statute, and would be deemed void if new legislation were to be brought in.

The Provider must be able to commission Best Interest Assessors (BIAs) to undertake assessments of adults aged 18 years and above in care homes and hospitals. They must identify, challenge and where possible, re-dress discrimination and inequality in all its forms. The Provider must ensure that BIAs can respect individuals’ qualities, abilities and diverse backgrounds and promote the rights, dignity and self-determination of individuals who might be deprived of their liberty. This is alongside being able to meet the timescale of the contract and providing assessments which will withstand legal scrutiny.

The Provider of the service is required to ensure all BIAs are either a registered Social Worker, Registered Nurse, Occupational Therapist or Psychologist.

The Provider must ensure all BIA’s are registered with either the Health Care Professionals Council, Social Work England or Nursing and Midwifery Council and provide details of their registration.

The Deprivation of Liberty Safeguards legislation 2009 requires at least two years post qualifying experience, to undertake BIA training, including annual refresher training. BIAs must also have experience within at least one of the following specialist fields:

-Learning Disability

- Mental Health

- Physical Sensory Impairment

- Brain Injury

- Safeguarding

four.1.11) Main features of the award procedure

The Authority will appoint a minimum of two (2) up to a maximum of five (5) Providers on this Framework agreement.

To be award a place on this Framework Agreement, providers must:

• Achieve at least a score of 3 out of 5 for each quality question to meet the minimum standard to enable award of contract. Scoring below a 3 will mean your bid may be deemed non-compliant and will not be evaluated further.

• Be within the top 5 highest scoring providers based on the award criteria which has been set at:

-Commercial 20%

-Quality (inc. Social Value) 80%

The total of the award criteria for the weighted sections above will be calculated and added together to give the final score of the tenderers bid.
