The contract is for technical support services related to the procurement of new rolling stock. This support will include, but is not limited to:

- Provision of resources to manage a market engagement exercise with the rolling stock manufacturer

market.

- Assistance in developing ITN documentation, including Train Technical Specifications (TTS), technical

question sets, technical delivery requirements, and aiding ScotRail strategy development in relation

to Cyber Security, Artificial Intelligence, and GDPR.

- Assistance with the development of the evaluation strategy for the technical elements of the ITN.

- Provision of technical resources to assist in the evaluation of applicant/bidder PQQ and ITN responses.

- Provision of technical resources to support the management and response to applicant/bidder technical

queries and clarifications throughout the procurement process.

Engineering and Technical Services in supporting the procurement of new rolling stock. The services will include but is not limited to:

- Support with market engagement exercise.

- Assist in the development of the Technical Specification, Scored Technical Questions, Management Plan requirements (deliverability) for the ITN, and associated evaluation strategy and scoring methodology.

- Assistance in the evaluation of applicants / bidders technical response to our PQQ and ITN.

- Assistance with the management and response to bidder technical queries and clarifications throughout the procurement process.

- Advice on key areas of train design.

These services are being procured through the CCS Framework RM6187 (MCF3) Management Consultancy Framework - Lot 8 (Infrastructure including Transport).

four.1) Description

four.1.1) Type of procedure

Award of a contract without prior publication of a call for competition in the cases listed below

  • The procurement falls outside the scope of application of the regulations

Explanation:

The contract is being awarded through and in compliance with the CCS Framework RM6187 (Lot 8) (the “CCS Framework”). As a result, there is no legal requirement to advertise the contract, as the framework has already been advertised. The contract has been awarded directly to Ove Arup & Partners Ltd under the CCS Framework, which permits a direct award.

Ove Arup & Partners Ltd had previously provided services to Transport Scotland and ScotRail for the initial services in connection with the suburban fleet procurement exercise. Given their extensive knowledge and experience in supporting rolling stock procurements in the UK, their particular experience and understanding of the Scottish Rail Network and the regulatory framework within which ScotRail operates, and their familiarity with this project as a result of their initial work, it is considered that the direct award under the CCS Framework is permissible in these circumstances.
