four.1) Description

Explanation:
In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI No.2019/697) this procurement shall be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 (DSPCR 2011) as amended (in particular by SI 2019/697 and SI 2020/1450).
Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate.
It is considered that this contract can be placed using the negotiated procedure without prior publication pursuant to Article 32(2)(b)(ii) and Article 32(3)(b) of Directive 2014/24/EU (Regulations 32(2)(b)(ii) and 32(5)(b) of the Public Contracts Regulations 2015). The Authority requires these rifles as partial replacement for the current in-service fleet of 1827F Biathlon Rifles for use in the Army’s “Winter Games” competition.
The Authority is unable to accommodate weapons from an alternative supplier as this would result in goods being supplied which would have different technical characteristics to those already in service, effecting the interoperability of the rifles. This would result in technical difficulties with incompatibility between existing and new weapons and accessories.
Ammotec UK Limited is the exclusive UK dealer for the Original Equipment Manufacturer (OEM) of the 1827 Biathlon Rifle. In these circumstances the Authority considers that single sourcing is justified for additional delivery of goods and that competition is absent for technical reasons.
