supplies having different technical characteristics which would result in incompatibility or disproportionate technical difficulties in operation and maintenance" The OEM awarded the contract has the intellectual property for the equipment used within context of this contract and has been maintained and managed by the awarded supplier as the Original Equipment Manufacturer (OEM) and own the intellectual property associated with the equipment. This proprietary equipment cannot be modified by another company.
