Description
The Office of the Public Guardian (OPG) is preparing to launch a tender for the provision of a service for surety bonds, for both deputyship bonds and guardianship (missing persons) bonds. Through this preliminarily market engagement notice, the Authority would like to invite interested suppliers to a webinar to highlight who we are, explain how we work and what we do, and share further details for the re-procurement of our combined contract requirements.
The Office of the Public Guardian (OPG) is an Executive Agency of the Ministry of Justice (MoJ), set up in 2007 following the legislation of the Mental Capacity Act 2005 coming into force (in 2007). OPG protects people in England and Wales who may not have the mental capacity to make certain decisions for themselves, such as matters relating to their health and finance. Our principal responsibilities are: registering lasting and enduring powers of attorney (LPAs and EPAs), supervising deputies appointed by the Court of Protection (CoP), supervising guardians appointed by the High Court, maintaining the public registers of deputies, guardians, LPAs and EPAs, and responding to requests to search the registers and investigating representations (including complaints) about the way in which attorneys, deputies and guardians are exercising their powers.
The Public Guardian is supported by OPG in the delivery of her statutory functions under the Mental Capacity Act 2005 and the additional functions from the Guardianship (Missing Persons) Act 2017. The Public Guardian's responsibilities extend throughout England and Wales. Separate arrangements exist for Scotland and for Northern Ireland.
The OPG will be combining both Guardianship and Deputyship Bond requirements into a single supplier contract. We intend to work in partnership with the successful supplier to implement service improvements through simplification and driving efficiencies, focusing on the customer experience throughout the application processes and timelines within.
The contract term will be for six years, with an expected contract mobilisation start on or before April 2026.

Engagement process description
The OPG and COP Guardianship and Deputy Surety Bonds Market Engagement Webinar will be held via Teams at 3.00pm on 22 May 2025. The Webinar presentation will last approximately 35 minutes with 20 minutes for Q&A following the presentation. The presentation Webinar will be presented by OPG, COP and MoJ.
