Explanation:

The Wildcat Delivery Team, part of the UK Ministry of Defence, entered into a 34-year arrangement with Leonardo UK Ltd for the delivery of the Integrated Operational Support (IOS) to the UK MOD AH and HMA Wildcat Fleet in 2011. This arrangement comprises of 5-year pricing segments, with the Wildcat Delivery Team and Leonardo UK Ltd intending to enter pricing period 3 in April 2022. PP3 extends support to include Wildcat Role Equipment, Support & Test Equipment and FASGW modified equipment.

It is considered that the contract for pricing period 3 can be placed using the negotiated procedure without prior publication of a contract notice pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011) for technical reasons. As the Original Engineering Manufacturer (OEM), Leonardo UK Limited are the only provider that has access to the Technical Drawings, Publications and Manufacturing Data pertaining to the Wildcat Aircraft which are required to meet the requirement and deliver aircraft that can be safely operated within the Wildcat Safety Case and Airworthiness requirements.
