two.1.4) Short description

Provision of Household Recycling Centre Services on a concession contract basis across Conwy and Denbighshire. The scope of the Contract Notice published encompasses the potential for a new contracting authority to join the concession contract during the term of the contract, provided that;

- The new authority is a contracting authority for the purposes of the Concession Contracts Regulations 2016;

- The new authority has duties pursuant to section 51(1)(b) of the Environmental Protection Act 1990 to provide places at which persons resident in the area may deposit their Household Waste;

- Any part of the administrative area of the new authority is located within 20 miles of any part of the administrative area of Conwy County Borough Council and Denbighshire County Council;

- The new authority requires services of a similar scope and nature to this contract;

- The modification does not amend the conditions of contract in any material way;

- The modification does not change the economic balance of the concession contract in favour of the concessionaire;

- The modification does not alter the overall nature of the contract; and

- The modification is in accordance with the review clauses set out in the contract.

The detailed mechanism to allow a new authority to enter the Contract would be agreed in the event such an opportunity arises, including their admittance into the Inter Authority Agreement. The extension protocol would likely comprise the Supplier providing an outline solution to an interested new authority, then a detailed costed proposal, with the new authority paying a fee if it subsequently decided not to utilise the Contract.
