Section four. Procedure

four.1) Description

four.1.1) Type of procedure

Award of a contract without prior publication of a call for competition in the cases listed below

  • The procurement falls outside the scope of application of the regulations

Explanation:

This contract is not an award without prior notice. This contract was awarded via an Open Procedure completed in 2021.

Modification is to increase awarded value by £374,122. This proposed value modification complies with Regulation 72 (1) (b) as stated below:

72.— (1) Contracts and framework agreements may be modified without a new procurement procedure in accordance with this Part in any of the following cases:

(b)for additional works, services or supplies by the original contractor that have become necessary and were not included in the initial procurement, where a change of contractor—

(i)cannot be made for economic or technical reasons such as requirements of interchangeability or interoperability with existing equipment, services or installations procured under the initial procurement, or

(ii)would cause significant inconvenience or substantial duplication of costs for the contracting authority,

provided that any increase in price does not exceed 50% of the value of the original contract.

The increase of an additional £374,122.00 is 36% of the original contract award value.

Any change of contractor at this stage would cause significant inconvenience to the ongoing service delivery. There are also technical grounds in that the current Contractor is the only body able to maintain and service the current solution.

The option to extend was included in the original tender documentation. Failure to extend will result in the service being without an Online School To Home Engagement Software tool for Nursery & Primary Pupils.
