four.1) Description

four.1.1) Type of procedure

Award of a contract without prior publication of a call for competition in the cases listed below

  • The services can be provided only by a particular economic operator for the following reason:
    • absence of competition for technical reasons

Explanation:

APAC are currently established at the Netheravon site through a different arrangement with Defence Infrastructure Organisation (DIO) and would remain there if there was to be a different winning bidder through a competition process.

If the Authority were to pursue competition and another supplier were to be successful, there are only one of two options to ensure the provision of services would continue:

a. The new supplier transports the aircraft from another location to the Netheravon site and back as and when required to deliver the service. This is technically impractical as external factors such as bad weather increases the risk of non-delivery of the training. This would also significantly increase the costs of the contract to accommodate additional fuel costs, which does not represent VFM. The Authority previous placed a contract with another Supplier based on this model and it was subsequently terminated due to failure to meet the contract deliverables and emerging costs.

b. The Authority would need to build a new hangar to provide the supplier with storage space for the aircraft on the days required. This also does not represent VFM. This would be a significant project and come at a high cost to the authority with no control over timescales as this would be delivered by DIO.

c. If an open procedure was ran the current supplier would have an unfair advantage and we would not be able to meet our obligations to provide all bidders with a level playing field. With APAC remaining on site with their other Commercial agreement, this would prevent us from being able to run a fair competition.
