four.1) Description

four.1.1) Type of procedure

Negotiated without a prior call for competition

Explanation:

The Royal Navy, part of the UK Ministry of Defence (“MoD”), intends to modify an existing contract with Kinsetsu Ltd, (Contract Reference 701300387) for the Provision of Queen Elizabeth Carrier Personnel Accounting and Location Trial to include an uplift to software versioning and support to HMS Prince of Wales to ensure the same level of functionality as exists on HMS Queen Elizabeth, including changes to allow for multiple RFID tags to be associated with a single user, development of an off-line app and remote telephone support. This will improve ease of use and utility of the system, and achieve maximum benefit from the Fleet Minor Trial. In accordance with the provisions of The Public Procurement (Amendment etc.) (EU Exit) Regulations 2020 SI No. 2020/1319, this procurement falls to be regulated under the provisions of the Public Contracts Regulations 2015 as amended (in particular by SI 2020/1319). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate.

It is considered that the award of the contract modification without prior publication of a contract notice in the UK e-notification service (in accordance with the relevant legislation) is lawful in accordance with regulation 72(1)(b) of the PCR 2015 because it constitutes a permitted modification under that regulation. This is because these additional support services have become necessary and to introduce a change of contractor at this stage cannot be made for economic or technical reasons as only Kinsetsu Ltd as the OEM has the necessary technical knowledge, expertise and proprietary design information, gained in part from installing and assisting in the trials of the existing PAL system on the HMS Queen Elizabeth Carrier and which is necessary to provide this support. In addition, there are very specific interoperability requirements between the Carriers requiring commonality of PAL systems across the fleet. To introduce a change in contractor at this stage would also cause significant inconvenience, delays and substantial duplication of cost for MoD, as it would result in the need to strip out and replace the current PAL system across the fleet.
