two.2.4) Description of the procurement

The original procurement exercise was a Mini-Competition via Lot One of the Insurance Services Framework RM3731.

It was a collaborative tender to setup Insurance Contracts for Wealden District Council, Rother District Council, Hastings Borough Council, Lewes District Council, Eastbourne Borough Council, Horsham District Council and Mid Sussex District Council.

The tender was divided into Lots (with the requirements of each Council forming each Lot) with each Lot further divided into Sub-Lots (each Sub-Lot relating to a specific type of insurance policy).

The purpose of the exercise was to setup all necessary contracts for all Councils' General Insurance requirements for the period 01/04/2019 - 31/03/2024.


Section six. Complementary information

six.3) Additional information

Horsham District Council took the decision to extend by 12 months their own Insurance Contracts (which were setup as a result of the aforementioned procurement exercise) as follows:

a) Contract with Protector Insurance for General Property Insurance and Commercial Property Insurance extended by 12 months to 31/03/2025 at value of £146,434.20 (inclusive of IPT).

b) Contract with Zurich Insurance UK Plc for Housing Property Insurance, Liability Insurance, Crime Insurance, Engineering Insurance, Computer Insurance, Personal Accident Insurance and Motor Insurance extended by 12 months to 31/03/2025 at value of £463,694.21 (inclusive of IPT).

c) Contract with JLT Specialty Ltd for Terrorism Insurance extended by 12 months to 31/03/2025 at value of £10,080.00 (inclusive of IPT).

The Authority has made the decision to modify the original contracts on the following grounds:

(i) the need for modification was brought about by circumstances which a diligent contracting authority could not have foreseen (the Authority initially looked at tendering for new insurance contracts as part of a collaborative tender however additional insurance information, neither previously required nor reasonably foreseeable at the time to have been required, needed to be collated and extrapolated for the insurance exercise and insufficient time was left for the tendering exercise by the time all the additional information was made available);

(ii)the modification does not alter the overall nature of the contract;

(iii)the increase in price does not exceed 50% of the value of the original contracts.

The intention of the Authority was to mimic the requirements of the modification ground under Reg 71 (1) (c) of the Public Contract Regulations 2015, recognising that this was a modification of a contract called-off from a Framework Agreement, so a standard Modification Notice was not applicable.
