four.1) Description

four.1.1) Type of procedure

Negotiated without a prior call for competition

Explanation:

The Lightning II Delivery Team (LDT), part of the UK Ministry of Defence (MOD), intends to place a contract with Aviation Spares and Repair (ASR) for the procurement of buffer replacement on the Wrap Around Maintenance Staging (WAMS). This contract has an estimated total value of £180,000.00 VAT included. In accordance with the provisions of The Public Procurement (Amendment etc.) (EU Exit) Regulations 2020 SI No. 2020/1319, this procurement falls to be regulated under the provisions of the Public Contracts Regulations 2015 as amended (in particular by SI 2020/1319).  Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (as required by in accordance with the relevant legislation) is lawful in accordance with regulation 32(2)(b)(ii) of the PCR 2015 due to technical reasons, and in accordance with regulation 32(5)(b) of the PCR 2015 for the additional delivery of goods as a partial replacement for existing goods as a change in supplier would oblige the contracting authority to acquire supplies having different technical characteristics which would result in incompatibility and disproportionate technical difficulties in operation and maintenance”

WAMS are used as a fall prevention platform whilst maintenance is being performed on F35 aircraft. As a fall prevention platform, the WAMS sit extremely close to the airframe. The WAMS was previously purchased from ASR on contract number LPT/50171. The LDT intend to purchase replacement buffers for all 9 WAMS systems to replace specific elements that have degraded over a short time which require modification to enable better effectiveness and improved performance. It is vital that WAMS do not interface with the allotted Air Vehicles and cause any damage to the coatings or structure of the Airframe. Replacement buffers from ASR are required to maintain this critical element in aircraft maintenance through ensuring compatibility with existing buffering and contact points and maintaining entire system interoperability. ASR will also be required to update the WAMS design drawings and their user manuals accordingly with all new information.

Only ASR has the requisite technical know-how, dimensions and information to carry out the services required and ASR are not prepared to authorise any third party to use or alter its technical information. LDT does not hold, nor does it have the right to use or release, the necessary documentation or information.
