four.1) Description

four.1.1) Type of procedure

Award of a contract without prior publication of a call for competition in the cases listed below

  • The services can be provided only by a particular economic operator for the following reason:
    • absence of competition for technical reasons

Explanation:

A negotiated procedure without prior publication (direct award) was followed in accordance with regulation 32(2)(b)(ii) of the Public Contracts Regulations 2015 due to competition being absent for technical reasons. The works, supplies, services are such that the essential requirements of the Council can only be met by a proprietary solution only available from a single supplier, because it is essential a continuous service is provided to ensure statutory obligations are delivered and swift resolution of any faults/issues are actioned, and there is insufficient time to undertake a full re-procurement exercise including mobilisation considering the complex nature of the requirements. For a contract of this nature at least a 3-month implementation would be required (which has been supported through soft market testing) to ensure a successful continuation in provision (from any change in service provider). This is a result of the transfer of complex data and niche requirements of each site (large number of sites with a different volume and nature of assets thus each site requires a different service to be undertaken) and to ensure the contract is suitably resourced from day one via any applicable TUPE transfers being successfully made and any subsequent recruitment/knowledge transfer to be made in order for a new arrangement to become fully operational. As such it is deemed Lorne Stewart to be the only supplier who can deliver the technical requirements of the contract within the specified timescales. As stated above the council has already undertaken soft market testing to better understand the market and options available and is currently undertaking a needs analysis to establish its future requirements and how best these should be delivered, with aim to procure a long-term arrangement. Unforeseen circumstances within the Council have resulted in the timescales and outcome above and this is not a result of actions to artificially narrow the procurement, as such there is no reasonable alternative or substitute to deliver the essential requirements.
