seven.2.1) Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):
To modify the above contract, as permitted under Regulation 72(1)(c) of The Public Contracts Regulations 2015 to include the following additional works/services: Extension of value and duration.
The overall value increases from £110m to £157.5m, Lot 1 increases from £95m to £142.5m, Lot 2 and 3 remain the same at £7.5m each.
seven.2.2) Reasons for modification
Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee.
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:
The reasons for the modification are consistent with the grounds in Regulation 72(1)(c) of the Public Contracts Regulations 2015, as all of the following conditions are fulfilled:
i. the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen. It had a greater requirement for services under the Framework than originally expected (the COVID-19 pandemic created a need to urgently procure additional services/supplies).
ii. the modification does not alter the overall nature of the contract. The overall nature of the framework agreement is unaltered; the number of lots, economic operators and subject matter of call-off contracts are all the same as before.
iii. increase in price does not exceed 50% of the value of the original contract or framework agreement (the overall value increases from £110m to £157.5m, Lot 1 increases from £95m to £142.5m, Lot 2 and 3 remain the same at £7.5m each)
