Section six. Complementary information

six.3) Additional information

This contract extension relates to the provision of a Pathology MES contract to Buckinghamshire Healthcare NHS Trust (the “Trust”). This was a contract awarded from a joint procurement process with Oxford University Hospitals NHS Foundation Trust in 2012, detailed in FTS/OJ: 2012/S 064-104454. Buckinghamshire Healthcare NHS Trust are part of the South 4 Pathology Network which includes Oxford University Hospitals NHS Foundation Trust, Milton Keynes University Hospital NHS Foundation Trust and Great Western Hospitals NHS Foundation Trust. As set out above, the South 4 Pathology Network is planning for a procurement process for a Pathology MES Contract across the network. Oxford University Hospitals NHS Trust has been leading premarket engagement with interested suppliers and the planned network procurement was first detailed in the PIN notice reference: 2022/S 000-012490 of the 13th May 2022. An update to the PIN will be released in September 2024 to provide additional details and trigger further pre market engagement. It is anticipated that the formal procurement process will involve dialogue and will be conducted as a competitive flexible procedure under the Procurement Act 2023. It is anticipated that this procurement process will formally commence with a tender notice in Spring 2025. The extension period for the Trusts’ current Pathology MES contract will avoid duplication of costs of redesign required when the South 4 Pathology Network implements the re-procured solution.
(Please note that due to timescales since original notice was published a new procurement system is being used the directive has had to be updated from 2004/18/EC to 2014/23/EU to allow this notice to be published as the new system does not recognise directive 2004/18/EC)

Need for additional works, services or supplies by the original contractor/concessionaire.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

The extension will be carried out in accordance with regulation 72(1)(b) of the Public Contracts Regulations 2015. The additional services are necessary to ensure continuity of clinical services and for technical reasons, the Trust is unable to change contractor at this stage to enable the pathology services at the Trust to be delivered. The current solution is linked to software that runs on over 30 different platforms across the Trust and is integral to the operation of the laboratories and therefore the provision of tests. This extension provides an interim solution that ensures consistency for calibration, methodology, quality control regimes, interfacing requirements for multiple complex instruments, operational requirements, and accreditation. During the extension, the South 4 Pathology Network will align operations, structures, and processes, including those associated with implementation of a single laboratory computer system in autumn of 2024. This will be the single most
