Explanation:
The Typhoon Delivery Team, part of the UK MOD, intends to award a 6 year contract to Rolls-Royce plc, with an estimated value of £500m over the 6 years, for the provision of in-service support services in respect of the EJ200 engine, which is fitted to the Typhoon aircraft. The intention is to place the contract for the period from 1st January 2024 to 31st December 2029.
In accordance with Regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of this contract without prior publication of a Contract Notice in the UK e-notification service (as required by the relevant legislation) is lawful in accordance with Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011 for technical reasons. This is because the EJ200 engine was developed under NETMA contracts placed under the Eurojet consortium agreement, as part of the Eurofighter programme, under which Rolls-Royce plc is the UK lead manufacturer for the EJ200 engine and the supplier designated to perform support services in respect of the EJ200 engine in the UK. In addition, Rolls-Royce plc is the only economic operator with the specialist know-how, equipment and tooling necessary to perform the services in the UK and the only economic operator with the infrastructure, testing capabilities and airworthiness certification to ensure the continued airworthiness of the EJ200 engine.
