two.2.4) Description of the procurement
Subject to committee approval the council plans to Award a three and a half year Contract extension, to Suez Recycling Recovery UK Ltd, for its existing Waste Management Services Contract, for the period Sept 2025 to March 2029.
Subject to committee approval the council plans to Award a three and a half year Contract extension, to Suez Recycling Recovery UK Ltd, for its existing Waste Management Contract, for the period Sept 2025 to March 2029.
The contract currently has no further options to extend so the proposed extension shall take the contract beyond its expected expiry date.
The extension will enable the Council to measure and assess the impact of the significant legislative and policy initiatives which will be implemented by the Scottish and UK Governments over the forthcoming years (including the Deposit Return scheme (DRS) and Extended Producer Responsibility (EPR)), on the Council's waste services and infrastructure and enable it to better specify the Council's future requirements.
This in turn will ensure any future tender exercise reflects this.
The extension shall be awarded on the grounds of:
1."Unforeseen circumstances" and 2. "Non Substantial Variation"
"Unforeseen circumstances" - impending significant legislative and policy initiatives (including the Deposit Return Scheme and Extended Producer Responsibility). The impact of its implementation now, is unknown.
It will likely have a significant impact on Council's recycling waste (composition/volume) collected & sent for processing together with as yet unknown effects on particular waste streams such as bulky waste, with concomitant effects on residual waste composition and volume.

Given the particular scope of this contract, the uncertainty re the impact of the impending legislative changes, the Council believes it prudent to refrain from engaging with the market for a new tender/contract, until more is known about the full impact of these on the council’s waste composition, volume, potential targets, and therefore services and infrastructure configuration.
