six.3) Additional information

This is a Provider Selection Regime (PSR) contract modification notice, under the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of doubt, the provisions of the Public Contracts Regulations 2015 do not apply to this award. This contract has now been formally modified.

Please note that the original contract award notice incorrectly describes the contract value as £19,999,996.00 GBP. This was an error and represents the contract value without the application of contract options including the option to extend the contract. The correct contract value at the point of award, including all contract options was £42,970,317.00 GBP and therefore this figure has been given at V.2.4 above. The original call to competition, the published terms of contract and the contract specification all made the options clear and the higher value would have been obvious to all tenderers when the competition was undertaken.

The decision to modify this contract has been taken through the Council's democratic processes by the Deputy Leader of the Council and Cabinet Member for Children Education and Young People's Services following a report submitted by the Corporate Director of Childrens Services.

No conflicts of interest have been identified or declared by the Council's decision maker in relation to the modification of this contract.

The aim of this service is to provide comprehensive and fully integrated treatment and care for any adult in Oxfordshire who is experiencing problems with their alcohol and drug use at any level.

The main objectives of the Service are:

- to support adults to reduce or end misuse of drugs and alcohol.

- to support adults in abstaining from drug- and alcohol-associated criminal or anti-social behaviour.

- to reduce harms associated with alcohol and drug use for those who misuse these substances.

seven.2) Information about modifications

seven.2.1) Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

The contract has been previously modified in accordance with the Public Contract Regulations 2015 as it was the regime in force at the point when the modifications were made. The total value attributed to these modifications is £3,377,638 ("PCR Modifications")

As this contract is a health service, this contract now falls under the The Health Care Services (Provider Selection Regime) Regulations 2023.

The value of the current modification is £404,254. Although the current modification has a value less than £500K the cumulative total when combined with the PCR Modifications is £3,781,892 which is 8.8% of the original contract value.

Under the current modification, the Council will expand the Oxfordshire Family Solutions Plus (FSP) Teams and fund a further 9.7 whole time equivalent staff for the period 1st August 2024 to 31st March 2028 inclusive (subject to the termination provisions of the Contract). The modification will also allow for more home visits to take place and for additional consumable costs to be met under the contract. This will allow this provision to better support children and families in need of help and protection through the FSP Teams, that are currently provided under the Contract

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Modification of this contract is made in accordance with Regulation 13(1)(d) of the Health Care Services (Provider Selection Regime) Regulations 2023 as both of the criteria in paragraph (2) are met. Therefore, the modification does not render the contract or framework agreement materially different in character; and, the cumulative change in the lifetime value of the contract or framework agreement since it was entered into or concluded is less than 25% of the lifetime value of the original contract or framework agreement when it was entered into or concluded.

An increase to the contract value was required due to the high level of inflationary increases experienced since the whole time equivalent staff price was set in 2019 when the contract was procured. In addition, the value did not sufficiently cover the on-costs or staff travel required, as the service has a higher level of home visits and travel across the localities than was originally anticipated. The contract value now also includes consumable costs such as drug testing kits and harm reduction materials not in the original procurement.
