Recent legislation changes require all WCAs to provide a free weekly kerbside collection of food waste that will come into effect at the start of the financial year 2026/27.
The current contract for the processing of green and mixed green and food waste by In Vessel Composting (IVC) is due to end the 31/12/2024. However, with a contract extension modification of up to 5 years, the new contract end date at the latest is 31/12/2029.

seven.2) Information about modifications
seven.2.1) Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):
The Council propose to extend the current contract for a period of between 2 and 5 years to take into account the legislation changes to come into effect at the start of the financial year 2026/2. The Council will retain early termination rights of such a contract for all or part of the services if required.
seven.2.2) Reasons for modification
Need for additional works, services or supplies by the original contractor/concessionaire.
Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:
A new requirement to collect food waste weekly will come into effect at the start of the financial year 2026/27. Most Waste Collection Authorities in England and Wales (apart from a small number of exemptions) will be revising both their collection and processing methodologies.
The Council's current contract for the processing of green and mixed green and food waste by In Vessel Composting (IVC) ends on the 31st of December 2024. Rather than a short-term interim procurement based on current specifications to suffice until April 2026, the Council propose a contract term extension as described in section VII.2.1), allowing time to investigate new technologies available and carry out a cost benefit analysis of such. To prepare and enable a new procurement based on this will be far more attractive to the market.
The modification is pursuant to PCR 72, in particular Regulation 72(1)(b)(ii).
