four.1) Description
four.1.1) Type of procedure
Award of a contract without prior publication of a call for competition in the cases listed below

Explanation:
The Regulations permit the modification of a contract where the changes proposed meet one or more of the prescribed tests as set out in Regulation 72. Having considered the information provided there would appear to be convincing reasons to modify this contract in accordance with;
Regulation 72(1)(b) Additional works, services or supplies “have become necessary” and were not included in the initial procurement and a change of supplier would not be practicable (for economic, technical or interoperability reasons) and would involve substantial inconvenience/duplication of costs - provided the change does not exceed 50% of the value of the original contract and;
Regulation 72(1)(c) whereby the need for the change could not have been foreseen by a “diligent” Department provided the changes do not affect the overall nature of the contract or exceed 50% of the value of the original contract value.
This is on the basis that this is an essential frontline service, to meet statutory obligations and is clearly in the public interest ; therefore there is no option to do nothing nor have a break in service.
Continuity of service is critical. These are complex , niche services. There is a very small market and capacity and capability are an issue.
This contract will be modified by £862,500 for a 19 month period – 1 July 2023 to 31 January 2025. Approval of this request will allow DVA to continue delivering this vital service during a period of change.
