Explanation:
The impact of the global COVID-19 pandemic has resulted in an unprecedented demand on Commercial Procurement Services (CPS) which could not have been reasonably foreseen by EANI. The contract was modified in April 2021 as per notice 2021/S 065-170095 and a further modification is now required to extend the contract for three months with the option to extend by a further period of three months with a total increase in value of £97,500, to allow for the running of an effective procurement exercise and the award of a robust contract fully compliant with the Public Contract Regulations. EA have commenced a procurement exercise for a new contract for these services, which is envisaged to be advertised in July/August 2021. The modification to this Contract is in accordance with Regulation 72(c) of the PCR2-15 in that: (i)the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen; (ii)the modification does not alter the overall nature of the contract; (iii)any increase in price does not exceed 50% of the value of the original contract or framework agreement.
