contract is communicated to the relevant economic operators. Debriefing by the Council shall be in accordance with the Public Contracts Regulation 2015 (as amended) (the

Regulations). Such information should be requested from the addressee in Section 1.1. If an appeal regarding the award of the contract has not been successfully resolved the Regulations provide for the aggrieved parties who are of the opinion that they have been harmed or are at risk of harm by a breach of the Regulations, to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought as soon as possible.

seven.2) Information about modifications

seven.2.1) Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

To add additional funding of £100k from the Supplemental Substance Misuse Treatment and Recovery Grant (SSMTRG) to support recovery system activities in Derbyshire to contribute to the From Harm To Hope recovery target and increase capacity to meet the service requirements of the Integrated Substance Misuse Service.

The additional funding will provide:

• further recovery system activities in Derbyshire throughout 2023/24.

• increase the number of people entering recovery in Derbyshire in 2023/24.

• further contribute to the FHTH recovery target of 24,000 more people in recovery nationally.

• forge new partnerships, and strengthen existing ones, between the current treatment provider and organisations that provide support to people in recovery, including DCC funded recovery projects.

• increase the geographical reach of recovery system activities in Derbyshire.

seven.2.2) Reasons for modification

Need for additional works, services or supplies by the original contractor/concessionaire.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

This is a relatively small modification to a large integrated substance misuse service to increase recovery opportunities for service users. A change of contractor is impractical from an economic perspective and could lead to disengagement of service users.

The modification is not considered to be substantial and does not alter the overall nature of the contract pursuant to Regulation 72(1)(e).
