The Council sought to make provision for its gas and electricity requirements from 1st April 2022 for a period of five years. The Council has now procured a fully managed service whereby the Managed Service Provider (MSP) will purchase energy for and on behalf of the Council via a framework compliant with the Public Contract Regulations, which amounts to approximately £6,000,000 per annum within its Corporate, Streetlighting and Schools portfolio including Academies. It will provide a flexible purchasing method of procuring energy and will provide an end to end billing and management service. It will take the form of a single contract with the MSP negating the need to have a separate contract with the energy supplier.

The values given in this notice are only estimations and are for the contract period of 5 years-the authority gives no guarantee or warranty or makes any representation as to the accuracy of any indicative volumes or as to the value of the work during the contract period. Schools will have the ability to leave the contract after three years if 12 months notice is given.

Cheshire East Borough Council incorporated a standstill period at the point information on the award of the contract was communicated to tenderers. That notification provided full information on the award decision. The standstill period, which was for a minimum of 10 calendar days provided time for unsuccessful tenderers to challenge the award decision before the contract was entered into. The Public Contracts Regulations, 2015 (SINo 102) provides for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland).
