Single supplier - technical reasons
The contracting authority intends to award this contract directly to Leica Microsystems UK in accordance with Section 41, Schedule 5 of the Procurement Act 2023.
The required services relate to a maintenance agreement, which is essential to deliver the operational requirements expected of the related capital equipment.
Following an assessment of the market, the contracting authority has determined that Leica Microsystems UK Ltd is the only supplier capable of delivering the requirement due to:
- Leica Microsystems being the Original Equipment Manufacturer (OEM) for the Proveo 8 system
- Only Leica can supply OEM firmware, software, diagnostics, calibrated optical parts, and RemoteCare services.
- Non‑OEM servicing would invalidate warranty and introduce clinical risk in high‑dependency surgical settings.
A review of the market confirms that no alternative providers can meet the technical or operational requirements within the necessary timeframe. Competitive tendering would create risks such as service interruption or non‑compliant delivery.
The contracting authority confirms that the proposed contract offers demonstrable value for money, taking into account supplier capability, whole‑life cost considerations, and the risks associated with competing the requirement.
