The Contracting Authority published an opportunity in Find a Tender on 11th April (reference 2023/S 000-010397) to invite suitably qualified providers to submit offers to deliver an Integrated MSK Service within South & West Hertfordshire. The community iMSK service aims to improve, support, manage and coordinate MSK needs and conditions delivered across primary and community care, but with access to expertise in secondary care for advice, collaboration and onward referral when required.
The Notice provided the following wording within Section 11.2.4 - Description of the procurement:
Potential providers should note that The Authority may wish to introduce additional services and / or expand the scope of the services during the lifetime of the contract (“Contract modification(s)”). Such contract modifications will be contemplated where additional requirements are similar and or complementary to the services already included in the Specification, at any given time. Such expansion would be by the addition of services commissioned by the Authority and / or other Contracting Authorities, as named in the Contract Notice. To this end, the Bidder should be aware that after the award of contract, there is a possibility that the successful Bidder may be offered a variation to the contract to include delivery of the services into the other ‘places’ within the boundary of The Authority, specifically West Essex place and/or East and North Hertfordshire place (as set out in the map provided within the procurement documents) in accordance with Regulation 72 (1) (a) of the Public Contracts Regulations 2015 (as amended The Public Procurement (Amendment etc.) (EU Exit) Regulations 2020).
The purpose of this Corrigendum is to provide further context to this statement.
The Notice also provided the estimate total value of £35m (including all options and extensions). This potential estimated total value has been increased, taking into consideration the aforementioned potential options, to £100,000,000.
The total value of the contract being offered for the scope of the services identified within the initial tender for the 5-year contract period continues to be £25,000,000 (exclusive of VAT). This is the value by which the price evaluation will be undertaken (the aggregate value of the contract (including all potential options and extensions is up to £100,000,000 excluding VAT).

The Authority confirms that 'delivery of the services into the other 'places' within the boundary of the Authority, specifically West Essex place and/or East and North Hertfordshire place' means the delivery of all, or part of, the services described in the iMSK specification.
The Herts and West Essex Integrated Care Board was incorporated on 1st July 2022. This brought together West Essex Clinical Commissioning Group, Herts Valleys Clinical Commissioning Group and East & North Herts Clinical Commissioning Group into a single organisation. As such, the HWE ICB is continuing to form and to organise its services in the best way to meet the needs of its patient population. Currently, there are no plans to expand the services into the West Essex place and/or East and North Hertfordshire place. The intention of including this is to create flexibility for the ICB to create a consistent service for its patients across all of its geographical areas if this is desired at a later date. Any decision to do so will be made in consultation with all key stakeholders, in consideration of existing contractual requirements within each of the 'places', and in accordance with the Procurement Regulations.
Any variation to the new contract will be dealt with between the incumbent provider and the Authority in line with the NHS Standard Contract Particulars in accordance with GC13 (variations). Bidders are referred to the draft Contract Terms and Conditions regarding how commissioners will manage such matters should they arise, which are available within the procurement documents to all Bidders.
Commissioners to not guarantee or grant any exclusivity in relation to any such service expansion during the life of the contract.
The Notice also provided the estimate total value of £35m (including all options and extensions). This potential estimated total value has been increased, taking into consideration the aforementioned potential options to extend the services across each 'place', to reflect a potential upper maximum contractual value of £100,000,000 over the aggregate term of the contract.
The total value of the contract being offered for the scope of the services identified within the initial tender for the 5-year contract period continues to be £25,000,000 (exclusive of VAT). This is the value by which the price evaluation will be undertaken (the aggregate value of the contract (including all potential options and extensions is up to £100,000,000 excluding VAT).
