four.1) Description

four.1.1) Type of procedure

Award of a contract without prior publication of a call for competition in the cases listed below

  • The procurement falls outside the scope of application of the regulations

Explanation:

MFDs are intrinsically linked to the design and delivery of NHSS services in particular the physical facilities, buildings, sites and staffing; at this time due to post Covid recovery and unprecedented pressures on NHSS services these areas remain uncertain and subject to recovery, review and planning / strategy processes meaning the MFD requirement including volume and type of machines is at this time uncertain.

Inflation in UK and globally remains high and unpredictable meaning future forecasts of pricing and supply chains are uncertain; the NHSS contract would for example require a period of fixed pricing that may not be viable for the supply chain and market to be able to support.

As a result it is deemed that a tender could not be satisfactorily carried out and supported by the market and therefore a further 12 month extension is necessary.

It is envisaged that during this period comprehensive supplier and market engagement can be carried out to inform the strategy with the tender process being commenced at the earliest opportunity.

The notification will incorporate a ‘standstill period’ of a minimum of 10 clear calendar days (or a minimum of 15 if the communication method used is not electronic) between the date on which the authority despatches the VEAT notice and the date on which the authority proposes to conclude the relevant Contract. The bringing of court proceedings against the authority during the standstill period will automatically continue the prohibition on entering into the Contract until the court proceedings are determined, discontinued or disposed of, or the court, by interim order, brings to an end the prohibition. The remedies that may be awarded by the courts before the Contract has been entered into include the setting aside of the decision to award the Contract to the winning tenderer. The bringing of court proceedings against the authority after the Contract has been entered into will not affect the Contract unless grounds for the imposition of special penalties under the Public Contracts (Scotland) Regulations 2015 can be established. Otherwise the remedies that may be awarded by the courts where the Contract has been entered into are limited to the award of damages.
