two.2.4) Description of the procurement

The City of Edinburgh Council is looking for a supplier to deliver a service for out of hours accommodation and care for those undertaking the Lothians and Edinburgh Abstinence Programme (LEAP) quasi-residential rehabilitation programme.

A Prior Information Notice (PIN) was previously released to seek market engagement to test capacity and capability to help develop our procurement strategy, and obtain Expressions of Interest from organisations who would potentially bid for some or all of the requirement to extend the accommodation provided.

Only one supplier was able to deliver the service.

Background

LEAP is a treatment and rehabilitation programme for those dependent on alcohol and other drugs (including opiates, stimulants, cannabis, tranquillisers etc.) and usually lasts 3 months or longer. It is suitable for those who want to achieve a substance-free recovery.

The programme is part of the services provided by the Addiction Treatment & Recovery Care Directorate NHS and is currently delivered in partnership with the City of Edinburgh Council, with third sector partner agencies, Alcohol and Drug Partnership across the NHS Lothian Board Area.

The Council consider this opportunity to be procured under the Light Touch Regime of Public Contracts (Scotland) Regulations 2015.

As this is a Health and Social Care type contract, the Council were permitted to enter into negotiations with the Cyrenians under the Procurement Reform (Scotland) Act 2014 (“the Act”), which states that Public Sector Organisations may award without seeking offers, considering the principles of procurement where relevant.

In this instance, as there was no suitable supply market other than the incumbent provider and this contract falls within the category of contracts covered by Regulation 74 of the Public Contracts (Scotland) Regulations 2015 and is being awarded in accordance with the process set out in Regulation 33, in particular Regulation 33 (1) section (b) where the works, supplied or services can be supplied only by a particular economic operator for any of the following reasons – (ii) competition is absent for technical reasons; there is a limited supply market.

It is a mandatory requirement of this Contract that a prompt payment clause is present, which ensures payment of sub-contractors at all stages of the supply chain within 30 days and includes an obligation to provide a point of contact for sub-contractors to refer to in the case of payment difficulties.

It is a mandatory requirement that organisations pay staff who work on the council framework pay at least the real Living Wage.
