four.1) Description

four.1.1) Type of procedure

Negotiated procedure without publication of a contract notice

  • The products involved are manufactured purely for the purpose of research, experiment, study or development
  • The works, supplies or services can be provided only by a particular economic operator for the following reason:
    • absence of competition for technical reasons

Explanation:

The C17CSAE Delivery Team, part of the UK Ministry of Defence, intends to enter into a Contract with Meggitt UK Limited for in-service support and maintenance services, including repairs, overhaul and maintenance, provision of spares and post design services, in relation to the High-Altitude Parachute Life Support System (HAPLSS) Capability, which capability is due to be replaced in approximately four years’ time. The Contract has an estimated value of £3,750,000 (VAT EX) and will have a duration of 4 years.

In accordance with Regulation 4 of the Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Therefore, prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate.

It is considered that this Contract can be placed using the negotiated procedure without prior publication of a Contract notice in the UK e-notification service (in accordance with the relevant legislation) pursuant to Regulation 16(1)(a)(ii) of the Defence and Security Public Contract Regulations 2011 as amended for technical reasons. This is because Meggitt UK Limited and companies now owned by Meggitt UK Limited are the original equipment manufacturers of the High-Altitude Parachute Life Support System (HAPLSS) Capability comprising the Aircraft Modular Oxygen Systems (AMOS), which enable parachutists to pre-breathe oxygen when flying at high altitudes, and Personal Oxygen Regulators, which are used in both flight and when parachuting from high altitudes, Meggitt UK Limited is the only supplier which has the capability to provide the required repair, overhaul, maintenance and post design services, provide spares and conduct the necessary climatic and altitude acceptance tests for the critical life support Oxygen Regulators and Meggitt UK Limited is the only supplier which has the tools, test equipment, know-how, technical expertise, skills and access to the technical documentation necessary to be able to undertake the services, provide the spares and conduct the climatic and altitude acceptance tests.
