Provision of a clinical waste collection and disposal services across 150 GP Practices, including various Branch Surgeries and Pharmacy sites within the Norfolk and Waveney region

Extreme and unavoidable urgency

The ICB are relying on the urgency provision in paragraph 13 of Schedule 5 to the Procurement Act 2023 permitting a direct award on the basis that the services to be supplied under the public contract are strictly necessary for reasons of extreme and unavoidable urgency, and as a result the public contract cannot be awarded on the basis of a competitive tendering procedure.

A procurement process has been undertaken and the award decision has been challenged. This has prevented final award and therefore requires a short term contract with the existing provider to ensure that there is a continuation of vital services for primary care settings (GP's and Pharmacy) whilst this challenge is resolved.

The Authority believes competition is absent for the technical reasons outlined above.
