four.1) Description

four.1.1) Type of procedure

Negotiated without a prior call for competition

  • No tenders or no suitable tenders/requests to participate in response to open procedure
  • Extreme urgency brought about by events unforeseeable for the contracting authority

Explanation:

A further competition had been issued via an existing framework (procured via open procedure) for the supply of electricity however due to the current geopolitical situation, none of the suppliers on the framework were willing to enter into a fixed price contract and no bids were received by the further competition closing date of 28.02.2022.

Due to the extreme and continuing market volatility, suppliers are unwilling to enter into contracts for the forseeable future. Under Electricity (Northern Ireland) Order 1992, Electric Ireland, as the incumbent supplier, will continue to supply electricity to Derry City and Strabne District Council under a Deemed Contract. This arrangement will last until prevailing market conditions allow a new tendering exercise, or 31st March 2023, whichever is soonest.
