Regulation 72(1) Contracts and framework agreements may be modified without a new procurement procedure in accordance with this Part in any of the following cases:-
(b) for additional works, services or supplies by the original contractor that have become necessary and were not included in the initial procurement, where a change of contractor-
The Authority is preparing to re-procure the services and in doing so it has become necessary to make referral to a Transfer of Undertakings (Protection of Employment) Regulations 2006 ("TUPE") specialist lawyer at Government Legal Department (GLD). The extension is required to enable continuation of services while the re-procurement is completed and a TUPE assessment carried out.
(i) cannot be made for economic or technical reasons such as requirements of interchangeability or interoperability with existing equipment, services or installations procured under the initial procurement, or
Technical experts engaged by Contech International for the service delivery are in short supply and difficult to engage and employ in the industry. Contech International was the only Tenderer during the last procurement exercise. A short-term change of contractor would create economic and technical difficulties as the experts are integral to the Authority's International Health Regulations (IHR) service delivery within the host country (Pakistan);
(ii) would cause significant inconvenience or substantial duplication of costs for the contracting authority,
The Authority intends to re-procure the services via a competitive tender. Changing contractor for a short term while the competitive tender is prepared and completed would be both costly and result in significant inconvenience to the Authority's global health operations in Pakistan potentially rendering them unable to meet the objectives of the IHR Project.
